1. These Terms & Conditions (“Terms & Conditions”) govern the relationship between:

Individuals who use (“User”) the website www.anaoglejan.com (“website”) and/or any services provided by the Company via the Site (“Services”).
1.2. Access and use of the website, including any page or section hereof, or any Service provided through the website, may be conducted only in accordance with these Terms & Conditions, which include the GDPR Policy and the Cookies Usage Policy, also posted on www.anaoglejan.com.
1.3. To use the Services, we may require the User to express agreement with these Terms & Conditions by a specific action constituting unambiguous consent (e.g., checking the box “I have read and agree to the website’s Terms & Conditions”).
1.4. To ensure compliance with the conditions for access and use of the Services, Users must verify, each time they access the website, these Terms & Conditions. Even if you omit to review the Terms & Conditions but still use the website, we will deem that you have accepted this set of Terms & Conditions (including any updates hereto).
1.5. If you do not agree with the provisions of these Terms & Conditions (including any updates), please do not use, or as applicable, stop using, the Site or the Services offered by us.

“Account” – the website section consisting of an e-mail address and a password by which a Buyer may submit an Order, and which includes information such as username, password, delivery address, and order history. The User must ensure all account information is accurate, complete, and up to date.

“User” – any natural person over 18 years old or legal entity registered on the website, who, by creating an Account, agrees to the website -specific clauses in the Terms & Conditions.

“Buyer” – any natural person over 18 years old or legal entity who creates an Account on the website and places an Order.

“Favorites” – a section within the Account that allows the User to create lists of products they wish to follow for potential purchase.

“Favorites List” – a section within the Account where the User can add products they wish to follow; they may modify the list by adding/removing products or transferring them to the Shopping Cart.

“Shopping Cart” – section within the Account where the User may add products they wish to purchase.

“Order” – the electronic document through which the Buyer expresses their intention to purchase products from the website.

“Contract” – the distance contract concluded between Seller and Buyer without their simultaneous physical presence.

“Confirmation” – the process by which the Company confirms receipt of the Order placed by the Client. Once the Confirmation is received, the Order may no longer be cancelled by the Client. Confirmation of the Order does not equate acceptance by the Company.

“Acceptance” – the acceptance of an Order by the Client is considered effective and a sale-purchase contract between Ana Oglejan and the Client is deemed concluded at the delivery and handover of the Products to the Client, provided all other requirements in these Conditions are met.

“Content” – all information on the website accessible via electronic equipment; any form of communication the Seller conveys to Users by any means.

“Commercial Communications” – messages via the website, email, or mobile phone by which the Seller conveys information about current or future campaigns, offers, retargeting campaigns, surveys, or general information.

“Transaction” – receipt or refund of an amount resulting from the sale of a product via the website, depending on the payment or refund method.
1. General Terms
By using this Site, you agree to the Terms and Conditions for its use. The owner of this website's content is Axa Proect S.R.L., a Romanian legal entity with its registered office in Bucharest, Sector 1, Intrarea Filioara No. 1, registered with the Trade Registry under no. J40/24889/1993, Unique Registration Code 4911225, tax attribute RO, phone +40745894044 (hereinafter referred to as "the Company"). Access, use of this website (hereinafter referred to as "the Site"), its information, services, and products are regulated by these Terms and Conditions, as well as by all applicable laws and regulations. By accessing and using the Site, you accept these Terms and Conditions without limitation or reservation and acknowledge that any other agreements between you and the Company are superseded by these provisions regarding the use of this Site. If you do not agree or accept these Terms and Conditions without limitation or reservation, please stop using the Site immediately. The entire content of this Site may be modified and is offered "as is" without any warranty of any kind, whether express or implied.
2. Content Ownership. Copyright
The Site and everything it contains, including, but not limited to, texts, images, data, graphics, symbols, web graphics, scripts, programs, and other data (hereinafter referred to as "Site Content" or "Content") are the property and copyright of the Company, with all rights reserved. Any Content consisting of a trademark, logo, or service mark is a registered and unregistered trademark belonging to the Company or third parties who have given the Company permission for their use. It is strictly forbidden to use any element of the Site Content, except as provided in the Terms and Conditions of use, without written permission from the Company or the owner of the Content. We also inform you that the Company will firmly exercise its intellectual property/copyright rights over the Site and Content, and will ensure these rights are respected, taking legal action (civil and criminal) against individuals guilty of illegal acts concerning the Company, the Site, and the Site Content, committed during and/or through the use of the Site. We also inform you that using any elements of the Content without obtaining prior written consent from the rights holders is punishable by law.
3. Site Usage
Access to the Site is permitted temporarily, and we reserve the right to withdraw or edit services without prior notice. We are not liable if, for any reason, the Site is not functional for a certain period. From time to time, we will restrict access to certain sections of the Site. We reserve the right to cease selling a product at any time, without any prior notice. All Ana Oglejan products presented on the Site are representative models for the brand's collections. Not all of our products are presented on the Site. The Company grants permission to use the Site under the following conditions:

You may download Content, but only for personal and non-commercial use and on the condition that you comply with the copyright and other intellectual property information contained in the Content.

Any other communications or materials you transmit to this Site, such as questions, comments, suggestions, or other messages, will be considered non-confidential and unprotected by intellectual property rights.
5. Liability. Limitation of Liability. Disclaimer
We inform you that by using this Site, you assume full responsibility. Neither the Company nor its branches, affiliates, management bodies, employees, agents, or third parties involved in the creation, production, operation, review, or operation of the Site will be liable for any direct, indirect, punitive, incidental, special, or any other type of damage, including, but not limited to, damages for loss of profit, data loss, or other intangible or immeasurable losses (even if the Company was previously informed of the possibility of such losses), resulting from: (i) the use or inability to use the Site's information; (ii) unauthorized access to, or damage to user transmissions or data; (iii) statements or actions of any third party on the Site's services; (iv) any other issue related to the Site's services.

The Company will cooperate with authorized authorities to hold accountable those who are guilty of such acts. The Company will also cooperate with any and all judicial bodies that legally request information regarding the identity of individuals who publish or transmit such information or materials; by using the Site, you expressly consent to the Company's suspension/interruption/prohibition of your access to the Site for any violation of the Terms and Conditions of use.
If the Company decides to suspend/interrupt/prohibit your access to the Site, you agree to: (i) immediately stop using the Site; and (ii) promptly destroy any copies made of any part of the Content. The Company will not be liable for damages, costs, liabilities, expenses (including attorney fees, enforcement costs, etc.), and amounts related to any dispute, claim, or action filed by a third party against the Company as a result of: (i) your negligence, misunderstanding, error, or omission, or (ii) your violation of the Terms and Conditions of use and/or applicable laws.
If any material made available on the Site, posted by third parties or users, is considered to infringe on copyrights or any other rights, this situation must be reported to info@anaoglejan.com. This Site is offered in this form without other guarantees. The Company is not and cannot be held responsible for inconsistencies, unavailability, or other defects of this Site or its Content.
6. Links to Third-Party Sites
The Site may contain links to other websites owned or operated by parties other than the Company. Such links are provided for your use only if you wish to. The Company does not control and is not responsible for the content, privacy or security conditions, or functionality of these third-party sites. Without limiting the above, the Company informs you that it assumes no responsibility for any part of the content of these third-party sites, and specifically, firmly informs you that it assumes no responsibility if these sites:

Lastly, placing a hyperlink to the Site requires prior written authorization from the Company. If you wish to place a hyperlink to our Site, you must first contact the Site manager at info@anaoglejan.com. The Company cannot, under any circumstances, be held responsible for the provision of sites that are the subject of a hyperlink from the Site and is not responsible, in any way, for the content, products, services, etc., available on or from these sites.
7. Revisions to these Terms and Conditions
The Company may, at any time and without prior notice, revise these Terms and Conditions. In relation to your obligation to comply with the Site's Terms and Conditions at each access, we inform you of your obligation to carefully review these Terms and Conditions periodically, before accessing the Site, to be aware of the rules regarding its use.
8. Force Majeure
The Company is not liable in any way in the event of a Force Majeure event, which is any event beyond the control of the Company, its branches, affiliates, directors or managers, employees, agents, or third parties involved in the creation, production, operation, or review of the Site, that would prevent the fulfillment of any of the obligations arising from these Terms and Conditions, including, but not limited to, denial-of-service attacks, non-fulfillment of obligations by a third-party host or utility provider, unforeseen technical problems, strikes, riots, fires, pandemics and any other natural events, war, hostilities (whether war is declared or not), invasion, illegal acts of third parties, armed mobilization, requisition, or embargo.

10. Applicable Law and Jurisdiction
These Terms and Conditions of use, as well as the use of the Site itself, are governed by the laws of Romania. The competent courts of common law in Romania will have exclusive jurisdiction over any and all disputes that arise from or relate to or are in connection with the provisions of these Terms and Conditions and/or the Site Content, or in the case of disputes where these Terms and Conditions and/or this Site are considered relevant facts for such disputes.
11. Rules and Guidelines Applicable to the Online Store
11.1. Placing an Order
Products sold by the Company can be purchased online by placing an order on the Site. An order on the Site can be placed by any natural person over 18 years of age or a legal entity. An order can be placed both through a customer account and directly, without an account. Opening a customer account offers at least the following benefits (the list is illustrative, not exhaustive): it facilitates interaction with the Company, allows for keeping a record of placed orders, simplifies the return and service process, etc.
We inform you that you are fully and directly responsible for ensuring the security of your account access data and you assume responsibility for any action performed on the Site. If your access data has been compromised, you must report the event to us as soon as possible. For orders placed online, after completing the order, you will receive a confirmation email. Based on the payment method, your order will be processed and you will receive information about the status of your order, either by email or by phone. If you have selected the card payment method, the order will be accepted and shipped after your credit card and information have been approved and verified.
If the order has not been confirmed, but the money has been withdrawn from your account, we will proceed to refund these amounts as soon as possible. If the products are unavailable, but due to an error the Site does not update in real-time and they still appear available, and you have already placed the order, we will inform you about the unavailability of these products and recommend similar products of equal or similar value that can be ordered. If you do not wish to order the similar products we recommend, we will cancel the order, and if you have already paid for the products, we will proceed to refund the money as soon as possible.
Order processing takes 1-2 business days. From the moment the order is processed, the products will be made to order within 14-19 business days.

Important: The choice of size and confirmation of order details remain the customer's responsibility.

For jewelry that allows for size adjustment, the modification can be made within the limits of the model's specifications. If this is not possible, a complete remake of the piece is necessary, with the costs borne by the customer.

For wedding rings, engagement rings, and rings with precious stones that allow for adjustment, resizing can be performed once, by a maximum of one size, free of charge.
The Ana Oglejan team is available for personalized consultation before order confirmation. We process and ship orders during our working hours from Monday to Friday, 9:00 AM to 5:30 PM. If we cannot make deliveries, we will announce this on our Site and on social media networks. We reserve the right to unilaterally decide, without providing any reason, whether or not to conclude a sales contract with you. We will have no liability to you if we refuse to proceed with an order. Ownership of the products will be transferred to you only after you have paid all amounts due for the products, including delivery costs. Simply adding products to the cart does not reserve them. The order is finalized only after completing all steps in the Checkout process and only after full payment for the products.
Payment is made online with a bank card, through the payment intermediary Stripe, and no additional fees are charged by the Company for card payments. Transactions are secure. Product delivery is carried out in Romania via GLS/Fan Courier/DHL, and internationally via GLS/DHL. Deliveries within Romania take 1-3 business days from the time the package is shipped and are free, while the delivery time outside of Romania, from the time of shipment, is up to 5 business days. The costs for international delivery are displayed on the Checkout page and differ depending on the delivery address (in the European Union or non-EU countries).
In case of duplicate orders, we reserve the right to keep only one of the orders active, and the other(s) will be canceled. You will receive an email notifying you of the cancellation of duplicate orders. If you have placed an online order for which you opted for online payment by bank card, and the payment has not been registered within 24 hours of placing the order, the order will be automatically canceled, and the reserved products will again be available in stock for free purchase by the Company's customers.
11.2. Product Price
The price of the products is displayed in LEI/ EUR/ USD/ AED/ GBP on the Site and includes value-added tax. If there is an error regarding the price displayed on the site, we will notify you as soon as possible, and we will either refund the additional amount you paid or request an additional amount. If the new price communicated is not satisfactory to you, you do not respond to our request, or we cannot contact you, within a maximum of 10 business days from the placement of the order, we will cancel your order and refund the amount you paid.
For some of the products displayed on the Site, prices will be communicated only upon request, given that they may differ depending on the specifics of the respective products (size, weight, material, color, etc.). Product prices may be updated/modified at any time, without any prior notice, and this update/modification will replace any previous price. The prices at the time the order is actually placed will apply to your order.
11.3. Maintenance and Care
The gold our jewelry is made of can be yellow, white, or rose. Gold is obtained by alloying the precious metal with a mix of metals that gives it its specific shade. To intensify the shine of white gold jewelry, it is coated with rhodium. The rhodium layer can wear off in 6-12 months, and the jewelry may lose its shine. Our jewelry is marked in accordance with the current legal framework as follows:

manufacturer's responsibility mark;

fineness mark (for 14 and 18 karat gold, platinum, silver);

mark of the National Authority for Consumer Protection - Department for Precious Metals;

our own warranty mark.
Ana Oglejan is not responsible for the loss of any item. For the proper care of your jewelry, we recommend:

Wearing jewelry with diamonds, precious stones, or pearls with care.

Storing jewelry in the boxes received with the products or in other jewelry boxes.
-
Not wearing jewelry during household activities.
-
Not wearing jewelry during physical activities/massages.
-
Avoiding contact with chemicals, as they may erode the metal.
-
Gold can lose its shine over time if it frequently comes into contact with agents such as perfume, salt water, skin creams, hairspray, chlorine, or sulfur.
-
Depending on the degree of use, we recommend that jewelry be examined and cleaned by a jeweler at least once a year.
The warranty provided does not cover damage caused to the jewelry due to failure to comply with the instructions mentioned in the certificate, accidents, negligence, improper use, or other factors unrelated to material or workmanship defects.
11.4. Repairs/Product Warranty
The warranty and quality certificate is issued in accordance with the laws on the sale of gold jewelry. Consumer rights are in accordance with the provisions of Art. 11 (8) of Emergency Ordinance no. 140/2021 regarding certain aspects of contracts for the sale of goods (hereinafter referred to as "OUG no. 140/2021").
Repairs for products under warranty will be performed free of charge within 15 calendar days, and if a remake of the jewelry is necessary, the term is 25 business days, if it is confirmed that the product damage was caused by a defect attributable to the Company. For defects that cannot be covered by our warranty, such as: scratches, excessive or improper wear, broken chain, gold discoloration, repairs will be performed at an additional cost, depending on the complexity and type of repair. The customer will be informed of this cost before the repair is processed. The pickup/delivery time for a repair is 15 calendar days, and in the case of a jewelry remake, the term is 25 business days from the moment of processing, taking into account the nature and complexity of the goods and the effort required to finalize the repair or replacement. Transportation costs will be borne by the customer, if delivery to an address is requested, or if the product is sent by the customer to our headquarters.
The warranty provided ensures consumer rights in accordance with OUG no. 140/2021 and Government Ordinance no. 21/1992 on consumer protection. Services included during the warranty period: jewelry repair, if a manufacturing defect is found; replacement with a similar model from the same category; a refund is issued only if the technical team confirms the existence of a production defect. Replacement with an identical or similar product can be made subject to available stock, without issuing a new warranty certificate.
The warranty does not cover: normal wear, knocks, scratches, breakages, detachments or mechanical deformations, improper wear, loss of stones due to impact. For these situations, we offer repairs for a fee. We do not provide buy-back. We do not lend products.
11.5. Returns
Return Policy
Each piece of jewelry made in the Ana Oglejan workshop is handcrafted and made-to-order with meticulous care. Our jewelry is created to become a lasting part of your story, which is why we maintain a return policy that protects the integrity and quality of our creations. Most of our jewelry is made to order to avoid excessive stock. These pieces follow a standard design from our collection and are returnable according to our return policy. In contrast, custom orders are unique pieces created specifically for you based on individual specifications (for example, engraved jewelry or pieces created/modified upon request, outside of the designs on the site). For this reason, these items are considered a final sale and cannot be returned or exchanged.
11.5.1. Eligibility for Returns

Returns are accepted within 14 days of delivery for unworn, undamaged jewelry in its original packaging.

Only jewelry that is defect-free, in its original condition, has not been worn, damaged, and has all original packaging and accessories attached with no signs of use, is eligible for exchange or return.

For hygiene reasons, earrings cannot be returned or exchanged.
11.5.2. Custom and Engraved Jewelry All custom jewelry, including engraved pieces, are a final sale. These items are created specifically for you and cannot be resold or refurbished.
11.5.3. Non-Returnable Items

Jewelry that has been polished/sanded or shows stains, scratches, dents, cracks, knocks, missing stones, etc.

Sale, sample, or promotional pieces.
-
Earrings (for hygiene reasons).
11.5.4. Faulty or Damaged Items If your order arrives damaged or defective:

Contact us within 48 hours of delivery at info@anaoglejan.com with your order number and clear photos.

We will arrange for a repair, replacement, or refund, depending on the situation.
11.5.5. Return Process

Send an email to info@anaoglejan.com to request the return.

Pack the item securely in its original packaging.

Ship the return with a trackable and insured service (the customer covers the return shipping costs, unless the item is faulty).
11.5.6. Refund Timelines

Approved refunds will be processed within 14 days from the date we receive the returned item.

Refunds are issued to the original payment method used during the purchase.

If your return is rejected (failed inspection), no refund is issued, and you will be contacted to arrange for re-shipment.
11.5.7. Return Shipping Costs

Customers are responsible for return shipping costs, including insurance and any applicable customs fees, unless the item is faulty or was shipped incorrectly.

We strongly recommend using a trackable and insured shipping service (e.g., DHL Express, UPS, or FedEx) to ensure a safe return.

Ana Oglejan is not responsible for lost or uninsured returns.
11.5.8. Failed Return Inspection

All returned items are carefully inspected upon receipt.

If a piece fails inspection (e.g., shows signs of wear, scratches, damage, or alterations), the return will be rejected.

The item will be shipped back to the customer, and the shipping costs will be borne by the customer.

We will notify you by email and provide payment instructions for the re-shipping fee.
We do not offer direct exchanges. If you would like a different piece, please initiate a return (if eligible) and place a new order.
11.5.9. Right to Refuse Repeated Returns We reserve the right to refuse multiple or abusive return requests from the same client. This policy protects the sustainability of our made-to-order production model and ensures fair practices for all our customers.
11.5.10. Return Shipping and Third-Party Fees

Customers are responsible for return shipping costs, including insurance and any applicable customs duties.

Refunds do not include third-party processing fees, such as:

Stripe or bank transaction fees

Currency conversion differences

International transaction charges

Refunds will only cover the net value of the product (excluding the above fees).
11.5.11. Important Note Jewelry loses a minimal amount of material during polishing, which is why we do not accept returns for pieces that show any signs of polishing or wear. Every piece of jewelry is photographed before shipping as a record of its quality. We would like to inform you that Ana Oglejan refunds the amount paid by the customer for the purchased product, but not the fees related to third parties (bank transfer, PayPal, MobilPay, currency exchange differences, etc.). Delivery time depends on the chosen product, if it is available in stock or requires a special order.
11.6. Recommendations for Purchased Products
For the proper maintenance of your jewelry, we recommend:

11.7. Specifications
GOLD White gold is a precious material that, at its origin, has a dark gray, opaque appearance. To give it a shiny, bright, and glossy texture, white gold can be introduced into a rhodium "bath," another precious material. The color of the metal can be affected by the long-term use of creams, perfumes, and body oils.
SILVER Silver is a white metal that, along with gold and platinum, is considered a precious metal. Unlike gold, it is a flexible, soft material that erodes easily. The blackening of silver objects left in the open air for a long period of time or in contact with water, humidity, perfumes, or with a certain pH of the epidermis, is explained by chemical reactions.
IMPORTANT NOTE
Jewelry loses minimal material during polishing. We do not accept returns for pieces showing wear or polishing signs. Every piece is photographed before shipment to document condition.
Customs, Duties & Taxes
All international orders may be subject to customs fees, import duties, and taxes once the shipment reaches the destination country. These charges are the responsibility of the customer. Ana Oglejan does not cover or reimburse any customs-related costs.
